These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Yellowwood (“Provider”) website located at the domain name [www.safariguideafrica.com, www.safariguideafrica.co.uk, www.safariguideafrica.de and safariguideafrica.se] (“the Websites”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.

Booking Conditions & Cancellation Policy:

Yellowwood is a South African company which operates the Safari Guide Africa brand located at www.safariguideafrica.com, www.safariguideafrica.co.uk, www.safariguideafrica.de & safariguideafrica.se, please see the contact details below. Yellowwood is not a travel agent, or a tour operator, but a tour broker with a close relationship to a number of suppliers whose properties, tours or other services are marketed on the above mentioned websites. When a booking is made it is not made with Yellowwood but with the relevant supplier of accommodation, tours or services.

All bookings and trips are subjected to the specific booking conditions and cancellation policy of the specific supplier. Customers are responsible for reading the booking conditions and cancellation policy of the relevant suppliers; these will be provided to the customer with the initial quote and travel itinerary. In the case of the suppliers of accommodation, tours or other services that also provide holiday activities, these will be subject to the terms and conditions of the provider and are governed by the laws of the country in which they operate.

Your reservation will become confirmed once you have provided your credit card details and paid the required deposits indicated on your invoice and when the supplier acknowledges receipt of your deposit/guarantee. An online confirmation will be sent to you with your travel itinerary. Any other amounts due from you other than any cancellation fees collected by Yellowwood on behalf of any supplier, will be made directly to the supplier concerned. As such, Yellowwood accept no liability in relation to any contract you enter into or for any services or arrangements you purchase or for the acts or omissions of any suppliers or other persons or parties connected with any arrangements.

In some cases Yellowwood will charge an initial non-refundable deposit on behalf of the supplier. These deposits are charged in South African Rand (ZAR), or if provided in another currency, at the equivalent amount using the current market conversion rate to South African Rand (ZAR) against the deposit amount.

If you need to cancel or make changes to a confirmed booking, cancellation/amendment charges may be payable to the supplier. The amount of such charges will depend on the individual supplier’s cancellation policy and these charges usually are dependant on the period of notice given. The cancellation policy of each establishment, tour operator or other service provider is provided to the customer with the initial quote. Travel For Life will charge an administrative fee of ZAR 250 for cancelling or changing bookings once a deposit has been received. Any money due to be returned to you will be processed by Yellowwood within 5 working days.

Nothing on this website constitutes an offer on the part of Yellowwood, or on the part of the suppliers. The matters detailed constitute an invitation to you to make an offer on the stated terms to purchase arrangements featured. Our suppliers have the right to accept or decline any such offer. All arrangements are specific to confirmation subject to availability.

Electronic Communications
By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-Commerce & Privacy

The Website (www.safariguideafrica.com) sells accommodation bookings online. The use of any product/service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.

The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

The Provider will supply all goods/services to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.

The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.

Payment

All credit card information provided by you will be handled on a secure server using 128-bit SSL technology. The secure server is separate to the server that runs the websites owned by Yellowwood (www.safariguideafrica.com, www.safariguideafrica.co.uk, www.safariguideafrica.de, safariguideafrica.se, www.travelforlife.se, www.upplevkapstaden.se, www.upplevsydafrika.se and www.south-african-safari.com) and is maintained by MyGate Communications (Pty) Ltd. MyGate Communications (Pty) Ltd. will hold all such information and only release it to Yellowwood in connection with the provision of Yellowwood services to you as stated in these terms and conditions.

Travel Insurance:

You are highly advised to take out personal travel insurance, at the time of booking, for all members of your party. It is your responsibility to ensure that the insurance you purchase is sufficient and appropriate for your specific needs.

Disabled persons:

Please note that Southern African hotels, guest houses, safari lodges, and other tour operators and service providers may not have facilities for the disabled that are of a same standard to those found in Scandinavia. Anyone suffering a disability should confirm with Yellowwood the suitability of the accommodation or service provider prior to making a booking.

Children:

Parents are responsible for making sure that children are supervised and should not book any excursion or activity that could prove a risk to their children. Please be aware that many safari activities are not suited for young children. Parents are also responsible for making sure that they inform Yellowwood if they are travelling with children so that no accommodation is booked that does not accept children.

Passport and Visa Requirements

The traveller is responsible for acquiring and checking necessary permits and visas before their departure, for example valid passport, visa, vaccinations and travel insurance.

Third Party Sites

The websites owned by Yellowwood (www.safariguideafrica.com, www.safariguideafrica.co.uk, www.safariguideafrica.de, safariguideafrica.se, www.travelforlife.se, www.upplevkapstaden.se, www.upplevsydafrika.se and www.south-african-safari.com) contain links to third party websites. Yellowwood does not control such websites and are not responsible for their content.

Exclusion of liability:

Whilst Yellowwood makes every effort to ensure the accuracy of the information published on the company’s websites (www.safariguideafrica.com, www.safariguideafrica.co.uk, www.safariguideafrica.de, safariguideafrica.se, www.travelforlife.se, www.upplevkapstaden.se, www.upplevsydafrika.se and www.south-african-safari.com), we cannot be held responsible for any errors, omissions or changes that may have occurred. All recommendations, opinions expressed and prices regarding properties and/or destinations displayed on the above mentioned websites are provided for guidance only. Personal descriptions have been written in good faith and are subjective. Services and facilities can be withdrawn at short notice and Yellowwood does not accept any liability for the descriptions given. All views expressed are our own and individual opinions may differ.

We do not accept responsibility for your direct dealings with the ultimate supplier of the accommodation/trips, once the introduction has been made. All accommodation/trip suppliers featured on www.safariguideafrica.com are themselves responsible for providing you with the final quote and booking conditions for your reservation.

Yellowwood does not accept responsibility for the accommodation, tours or other services featured on the above mentioned websites. If during the course of the holiday you have any reason for complaint you should contact the accommodation provider, tour operator or other service provider so that remedial action may be taken.

Yellowwood will not be liable for any loss or damage or other sum or claim of any nature whatsoever (direct, indirect, consequential or other) which arises, directly or indirectly, in connection with this website including, for the avoidance of doubt and not by way of limitation, any use of any information or material contained in this website or any inability to access or use this website.

Updating of these Terms and Conditions

Provider reserves the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Limited License to General Users

Provider grants to the User, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.
This Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of Provider. The User may visit the Website without providing any personal information. Choice of Law

This Website is controlled, operated and administered by Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. The User may not use this Website in violation of South African export laws and regulations. If the User accesses this Website from locations outside of South Africa, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect.
